Recommendations need to be finalized by the city commission

A plan that proponents claim will make it easier for property owners and developers to build mixed-use, residential projects in Miami’s Wynwood neighborhood while preserving its eclectic character cleared its first hurdle.
At its regular meeting last night, the city of Miami Planning, Zoning and Appeals Board unanimously approved a slate of changes to zoning and land use designations that would eliminate most industrial uses and allow denser residential developments on roughly 205 acres in Wynwood. The recommendations still need to be finalized by the city commission.
Currently, property owners and developers are required to file individual applications to change industrial designations for Wynwood parcels. About 104 acres would go from industrial to general commercial use, while the remaining acreage (which is already zoned commercial) will be permitted more intense residential uses.
The board also recommended approving Wynwood as the city’s first Neighborhood Revitalization District, which will encourage builders to create wider sidewalks, pedestrian walkways within large projects, provide financial incentives to developers who preserve warehouses, and make it easier to construct affordable housing.

Joseph Furst, Wynwood director for Goldman Properties, one of the largest landowners in the neighborhood, hailed the plan as a solution to the piecemeal rezoning requests that have taken place in the last two years.
“This is the most exciting thing to happen to the neighborhood that all of us poured our hearts into,” Furst said. “We have created incredible momentum. Now it’s time to create a place we can call home.”
Jonathon Yormak, a principal with Madison Avenue-based real estate investment firm East End Capital, told board members the zoning changes would allow his company to quickly move forward with two development sites he and his partners have planned in Wynwood. East End, along with Yellow Side Ventures, owns seven acres in the neighborhood and already broke ground on a 23,500-square-foot retail and restaurant project located on Northwest 23rd Street, just west of North Miami Avenue. East End and Yellow Side paid $5.3 million for the site last year.
“We believe Wynwood is destined to be a place where millennials will relocate and where knowledge based users want to be,” Yormak said. “We want to build affordable housing, but the existing zoning doesn’t allow you to do that.”
For the past 18 months, property owners and other neighborhood stakeholders provided input to members of the Wynwood Business Improvement, its consulting firm PlusUrbia, and the city’s planning and zoning staff on how to create the Neighborhood Revitalization District, said Steven Wernick, a Miami-based land use lawyer at Akerman LLP who assisted in the plan’s development.
During the development of the plan, they evaluated neighborhoods around the country and Canada that transformed from industrial uses to commercial and residential uses such as Williamsburg, Brooklyn, the Pearl District in Portland, and Yaletown in Vancouver, Wernick said.
“The goal is to allow for mixed use developments that will really help bring Wynwood to the next level,” he said. ‘These changes will allow for multifamily uses, offices, and a host of other commercial uses that will turn the neighborhood into a place you can live, work and play in.”
At the same time, Wynwood would retain its edgy aesthetic by giving developers incentives to preserve the existing inventory of properties. “It still encourages the arts and hosting events, keeping with Wynwood’s character,” he said. “This has been a model initiative in that the development community, the people in the neighborhood and city have come together to collaborate and compromise.”

Individual property owners protected from bulk condo investors under new law

               

 

Investors and developers looking for distressed condominiums to convert into apartment buildings will have a harder time doing so in Florida. On Tuesday, Gov. Rick Scott signed a new law that grants a slate of new protections for property owners who don’t want to sell their units, but are being forced to sell. The number of optional condominium terminations rose during the downturn because developers that owned a majority of units in a condominium development wanted to convert to rental apartments or sell the property for conversion to rentals, said Jeffrey Margolis, a Fort Lauderdale-based partner at law firm Berger Singerman. He added that condominium terminations also occur in older condominiums where the unit owners receive an offer to sell an entire condominium to a developer.

“The new law is a disincentive for investors and developers,” Margolis said. “It could make [condo terminations] economically unfeasible for them.”
For example, if a bulk owner owns 80 percent of the units in a condominium, the owners of the other 20 percent must be compensated at least the fair market value of their units or the original purchase price paid for the unit, even if the current value is lower. But the owners must be current with their assessment fees and mortgage payments.
In the case of a unit owner whose unit was granted homestead exemption, the bulk owner must pay an additional relocation payment in an amount equal to 1 percent of the termination proceeds allocated to the non-bulk owner’s unit.
The law passed with overwhelming support in the state Senate and state House because it was viewed as protecting consumers. Following the 2008 crash, developers and bulk condo buyers amassing a majority of the units at empty condo buildings would seek to terminate condo associations, a practice that has led some homeowners to lose title to their units against their will.
“There was a negative impact to people who were being thrown out of their units and not getting what the unit was worth,” Margolis said. “The law could give potential single unit buyers peace of mind that they won’t be subject to a condo termination without being adequately compensated.”
The law also places additional burdens on bulk owners by preventing a plan of termination from becoming effective if the first mortgages for all the unit owners have not been paid off. In addition, a bulk owner will have to wait 18 months to offer a second plan of termination if the first one is rejected by the individual unit owners.
The changes, which are effective immediately, makes optional terminations of a condominium more difficult, Margolis said. “Although the new legislation was intended to help unit owners in a distressed condominium facing termination, the legislation may have the unintended consequence of hurting unit owners by making making it more expensive to terminate distressed condominiums,” he explained.

Miami Worldcenter project to feature new condo towers

Developers confirm residential plans during recent real estate industry event

New condo towers will be an integral part of the overall plans for the recently approved recently Miami Worldcenter mixed-use complex slated to be developed on 27 acres of vacant land located west of Biscayne Boulevard in Greater Downtown Miami.
For the first time, developers Nitin Motwani and Art Falcone publicly confirmed their decision to incorporate new condo towers into phase one of the planned $2 billion Miami Worldcenter complex during a question-and-answer session at last week’s CBRE Florida Multifamily Summit at the JW Marriott Marquis Miami hotel.
“The interesting thing that we are trying to do is distinguish and create different types of product,” Motwani told a standing-room-only crowd. “We think that is part of what makes Miami Worldcenter interesting. We will have a big-box hotel. We will have a boutique hotel. We will smaller condos. We will have larger condos.
“We will have a for-rent product as well,” he added.
Falcone echoed this overall vision to include a condo component at the Miami Worldcenter project, which is planned to feature an 1,800-room Marriott-branded hotel and expo center plus a 765,000-square foot shopping center anchored by the retailers Macy’s and Bloomingdale’s.
“There will be a tower with large square footage units of, I would say, 1,500 square feet or more,” Falcone said. “There will be a tower with small square footage units for sale.”
The developers declined to reveal any additional specifics – such as the number of units, prices or project names – about the planned condo towers, promising details would be announced in “short order.”
Before last week’s confirmation, the developers of the Miami Worldcenter had avoided commenting publicly on whether the 1,200 residential units planned for the 10-block site would be constructed as apartments for rent or condominiums for sale.
Coinciding with last week’s developer confirmation of planned condo projects, e-mails were distributed on that same Thursday to the real estate brokerage community foreshadowing a “signature residential tower” going by the name Paramount Miami Worldcenter that “is ready to be announced,” according to marketing literature.
As of now, developers are proposing 64 new condo towers totaling nearly 18,500 units in the Greater Downtown Miami market that stretches from the Rickenbacker Causeway north to the Julia Tuttle Causeway, and Biscayne Bay west to I-95, according to the preconstruction condo projects website CraneSpotters.com.

To date, developers have announced eight new condo towers totaling more than 1,300 units in Greater Downtown Miami’s Central Business District submarket that stretches from the Miami River north to the MacArthur Causeway.
By comparison, developers have proposed 32 new condo towers totaling nearly 10,100 units in the Brickell Avenue Area submarket that stretches from the Miami River south to the Rickenbacker Causeway.
An additional 24 condo towers totaling nearly 7,100 units have been announced for Greater Downtown Miami’s Biscayne Boulevard Corridor submarket that stretches from the MacArthur Causeway north to the Julia Tuttle Causeway.
The unanswered question going forward is whether presale condo buyers who are today searching for new units in Greater Downtown Miami will delay purchasing in previously announced preconstruction projects until the details of the Miami Worldcenter are revealed.

Nonprofit puts Lincoln Road building on market

ArtCenter South Florida owned Miami Beach property since 1988

ArtCenter South Florida could cash in on the property investment flurry occurring on South Beach’s Lincoln Road.
The nonprofit announced on Tuesday that it plans to sell its nearly 18,000-square-foot building at 800-810 Lincoln Road. ArtCenter also owns a building at 924 Lincoln Road. That property is not for sale.
Chris Lentz and Robert Kaplan of Ackman-Ziff Real Estate’s Miami office are marketing 800-810 Lincoln Road on behalf of ArtCenter, which paid a mere $700,000 for the property in 1988.
ArtCenter cited a desire for “additional resources” for the organization’s expansion plans in Tuesday’s written announcement.
“The timing of this could not have been any better as the organization can now expand its exhibitions and educational outreach programs and increase the resources that are provided to the current and alumnae artists enabling them to continue to thrive,” ArtCenter chairwoman Kim Kovel said.— Eric Kalis

Florida homeowners to get $9.2B in mortgage relief

Lenders honor national settlement that impacts 120,000 borrowers statewide

Florida homeowners are set to receive $9.2 billion in relief through the National Mortgage Settlement.
The state attorney general’s office announced the nation’s largest banks honored their obligations under the settlement on Tuesday, the Palm Beach Post reported. The agreement was originally reached in February 2012. It allowed lenders to atone for some of their foreclosure-related practices after the housing market collapsed.
Of the nearly 632,000 mortgage holders nationwide to get reimbursed, 120,000 are located in Florida. A total of $50.4 billion in relief was provided by the lenders. Florida got a special guarantee promising $4 billion in principal reductions, mortgage modifications and refinancings.
“I am very encouraged by what we have accomplished so far but I realize that there are still many Floridians facing the loss of their family homes and struggling to get back on their feet,” Florida Attorney General Pam Bondi said. — Eric Kalis

 

Vacant Miami parcel sold through bankruptcy court

The final property from Miami developer Renzo Renzi’s crumbled empire has been auctioned off for $4.2 million, The Real Deal has learned.
RBC Acquisitions Group won last week’s bankruptcy auction of a vacant Miami property previously owned by a Renzi-managed company, according to bankruptcy court records. The buyer of the 1.3-acre property at 3170 Southwest 22nd Street is tied to Coral Gables-based BF Group LLC. The property’s zoning allows for residential, hospitality, office and other forms of commercial development.
The Blue on Coral Way, which was managed by Renzi, paid $1.7 million for the property in 2002. The company was unable to develop the land before the real estate downturn. It lost an $18.2 million foreclosure judgment for that property and a Brickell-area site in December 2012.

Jimmy Buffett-themed resort set to open in July 2015

The Jimmy Buffett-themed Margaritaville Hollywood Beach Resort remains on track for a July 2015 opening.
Construction of the $147 million resort on five city-owned acres at Johnson Street and A1A has progressed to the fifth floor, the Sun-Sentinel reported. Developer Lon Tabatchnick said the project is on schedule and within budget following the first six months of construction.
Plans for the 349 room resort include seven restaurants and bars, oceanside pools, a wave ride and 35,000 square feet of convention facilities.
Some neighbors, including the adjacent Beach Market store, have complained about a loss of customers since Margaritaville construction began. The Johnson Street parking garage was closed before the project’s groundbreaking, which eliminated 700 spaces frequently used by Hollywood Beach visitors. — Eric Kalis

The Whitman family enjoyed a record sales year at their high-end Bal Harbour Shops.
Average sales at the retail hub rose 7.4 percent from 2012 to 2013, South Florida Business Journal reported. The shops generated an average of $2,800 per square foot in sales last year. Numerous tenants, including Dolce & Gabbana and Prada, took the opportunity to expand in 2013.
“Our specialty department store category, comprised of Neiman Marcus and Saks Fifth Avenue, was up solid double digits for the year, as was our restaurant category,” Bal Harbour Shops operating partner Matthew Whitman Lazenby told the Journal.
The 6,400-square-foot Grill at Bal Harbour restaurant is set to open soon at the mall.

MIAMI (January 31,  2014) – The year 2013 was a watershed year for million-dollar plus properties in Miami-Dade County, and EWM Realty International, one of the largest real estate services firms in America, and a South Florida exclusive affiliate of Christie’s International Real Estate, was at the forefront of the expansive growth.

The 50-year residential real estate brokerage firm was number one in Miami-Dade County once again last year for the total number of million-dollar-plus residences sold, as well as total dollar volume.

            According to data from the Southeast Florida Regional Multiple Listing Service (MLS), EWM had a total of 420 single-family home and condo sales in excess of $1 million for the period of January 1 – December 31, 2013, reflecting $900 million in total sales. That number is 26% higher than its next closest competitor who had 334. The remaining top five brokers had a total of 295, 162 and 96 sales, respectively.

            “The sale of million dollar-plus homes and condos grew by 27% in 2013 vs. 2012, “ said EWM President & CEO Ron Shuffield.  “The ongoing impact of the international buyer, evolving markets such as China, and a sharp increase in the number of buyers from the northeast, continued to further South Florida’s appeal as a truly global market.”

            “Miami-Dade’s million-dollar plus market has been rapidly evolving,” continues Shuffield. “With exponential growth of art and cultural offerings, the region has hit its stride in the global residential real estate arena.”

A recent report from Christie’s International Real Estate, titled ‘Atlantic Insights,’ includes Miami with New York and London as three of the most vibrant world cities currently attracting the globally affluent buyer. 

            In the period 2003 to 2013, the number of million dollar-plus homes and condominiums that have been sold in Miami-Dade has grown three-fold, from 628 annual sales at year-end 2003, to 1,918 at year end 2013.

Art Basel productive for Miami real estate players

From Brickell to North Miami, developers, brokers and other real estate players strategically positioned themselves to capture attention from Art Basel Miami Beach patrons.
More than 20 real estate events were held throughout Miami-Dade County during Art Basel week. The annual show brings tens of thousands of wealthy art collectors and other tourists to the county to kick off South Florida’s busy winter season. Those pushing new residential development and existing buildings in the area capitalized on the select marketing opportunity last week.
Signs indicate the efforts will pay off.
Aria Development Group took a big step toward selling out the remaining five units at its luxury 321 Ocean project in Miami Beach’s South of Fifth neighborhood. Moments before sitting down for an interview with The Real Deal at Aria’s VIP lounge on Friday, Aria principal David Arditi received a verbal offer from an undisclosed buyer for two 321 Ocean units. Aria set up the lounge at Milo’s Restaurant to engage potential buyers during Art Basel and promote the $25 million penthouse at 321 Ocean, which has been under construction since October.
“Art Basel shines a terrific spotlight on the city,” Arditi said. “We are trying to brand ourselves as a company. This is a good opportunity to do that.”
Further north, Argentinian developer Alan Faena used Art Basel week to pull back the curtain on his potentially transformative Faena Miami Beach mixed-use project, planned for several blocks along Collins Avenue. Faena started with an exclusive dinner at the Faena Collaboratory, which includes the sales center for the 47-unit Faena House.
During the A-list dinner, acclaimed director Baz Luhrmann and Academy Award-winning wife Catherine Martin mingled with real estate heavyweights like New York’s Robert Futterman. Luhrmann and Martin are collaborating with Faena to reposition the former Saxony Hotel at 3201 Collins Avenue.
Faena also hosted daily invite-only asados, or Argentinian barbeques, at the development site.
“We use Art Basel to make a big sales push,” Douglas Elliman broker Erik Schneider told The Real Deal. Schneider is handling sales at Faena House.
“We spent months putting together the guest list,” he said. Dinner guests included “people who partnered with us, potential buyers and people in the art world.”
Faena was one of numerous Miami and New York projects promoted by Douglas Elliman during Thursday night’s event at the VIP Collectors Lounge inside the Miami Beach Convention Center. That gave the firm a chance to tout its “penthouse collection” to the ultra-wealthy. Several Russian brokers and potential buyers chatted with Elliman chairman Howard Lorber and other company executives while perusing marketing materials for the developments.
EWM Realty and affiliates at Christie’s International Real Estate also took the VIP event route for Art Basel. The companies sponsored Art Miami 2013 in Midtown Miami and hosted an invite-only reception in the middle of the fair, which featured works from 190 art galleries. Many power brokers showed up for Friday’s reception, including Miami Beach-based Esther Percal and prominent Beverly Hills agent Jeff Hyland, whose artist wife Lori had her work on display nearby.
With the latest Art Basel week concluded, South Florida’s real estate professionals shift focus to converting the leads generated during the event into completed sales.By Eric Kalis

Art Miami Fair Helps Luxury-Home Brokers Connect with Potential Buyers

    

Art Miami has lined up sponsors including Maserati and Christie’s International Real Estate, which signed on last year. Christie’s is also an Art Wynwood sponsor, and an affiliate broker was a sponsor of Art Southampton this summer.
Ron Shuffield, president of EWM Realty International/Christie’s, which has offices throughout South Florida, said the fair helps brokers of luxury homes connect with the right crowds.
“We know that some of our customers will meet us there because they come with the intention of buying,” he said. “We’ll have further discussion then, we’ll look at properties while they’re here. For people kind of casually strolling through, many of those are just building relationships.”
Christie’s clients also provide a boost to the fair, Shuffield said. He recalled a home buyer who attended an Art Miami cocktail reception.
“While he was at the fair, he bought a little sculpture; I can’t remember how much it was, but it was over a million dollars,” Shuffield said. “There is so much wealth coming to Miami now, it’s sometimes hard to grasp how quickly this is happening.”
And Korniloff believes that the market could have room for more venues to sell art.
“We feel that the South Florida market has some other opportunities; the question is timing,” Korniloff said. “This business is still in a growth mode.”
